    ORDER OF THE LIEUTENANT GOVERNOR IN COUNCIL

    Order in Council Number 1462 Approved and Ordered December 1, 1998

    Executive Council Chambers, Victoria

    On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that, it being in the public interest,

      (a) the order of the Environmental Appeal Board (Appeal No. 95/31(b)), dated May 29, 1998, given in the matter of an appeal by Celgar Pulp Company under section 44 of the Waste Management Act, and

      (b) Permit PA-03080, dated August 17, 1995,

    are varied as set out in the attached Schedule.

      SCHEDULE

    1. The orders of the Environmental Appeal Board (Appeal No. 95/31(b)), dated May 29, 1998, at page 8 of the decision following the words "Therefore the Panel makes the following orders:" are varied as follows:

      (a) the first order of the Environmental Appeal Board is rescinded;

      (b) the second order of the Environmental Appeal Board is rescinded and the following is substituted:

        2. Subsection 1.3.2 of amended Permit PA-03080, dated August 17, 1995, is amended by striking out

        "Sulphur Dioxide 24 hour average 300 ppm, while incinerating

        DNCG, hog fuel and natural gas"

        and substituting

        "Sulphur Dioxide 24 hour average: 234 ppm, while incinerating DNGG;

        1,700 ppm, while incinerating DNCG and

        CN'CG";

      (c) the third order of the Environmental Appeal Board is rescinded and the following is substituted:

        3. Subsection 1.3.2 of amended Permit PA-03080, dated August 17, 1995, is amended by adding the following immediately above the NOTE:

        "NOx as NO2 not to exceed 325 ppm,";

      (d) the fourth order of the Environmental Appeal Board is rescinded and the following is substituted

        4. Subsection 1.5.2 of amended Permit PA-03080, dated August 17, 1995, is amended by adding the following immediately above the NOTE:

      "NOx as NO2 not to exceed 250 ppm,";

      (e) the fifth order of the Environmental Appeal Board is rescinded.

    2. Subsection 2.6 of amended Permit PA-03080, dated August 17, 1995, is repealed and the following is substituted:

    Use of Lime Kiln as CNCG Incinerator

    2.6.1 (1) The percentage of the time that CNCG is incinerated in the lime kiln must be maximized and the percentage of time CNCG is incinerated in the #2 Power Boiler must be minimized.

    (2) A target for not burning CNCG in the #2 Power Boiler for more than 5% of the time must be aggressively pursued.

      2.6.2 The actual percentage of time that the #2 Power Boiler is incinerating CNCG must be calculated for every calendar month by dividing the number of hours during the calendar month that CNCG was incinerated in the #2 Power Boiler by the number of hours during the calendar month that chips were fed to the digester, multiplied by 100.

      2.6.3 The permittee must, on a monthly frequency, submit a report to the Regional Waste Manager providing the percentage of time that the #2 Power Boiler incinerated CNCG during the previous month, calculated in accordance with subsection 2.6.2.

    3. The condition which Celgar Pulp Company must meet with regard to its emissions to the environment are those in amended Permit PA-03083, dated August 17, 1995, as amended by items I and 2 of this Schedule, and in the Waste Management Act and the regulations made under it.

    4. For greater certainty, the Regional Waste Manager is fully empowered to exercise his or her statutory responsibility and authority provided by the Waste Management Act with regard to considering new information that may arise over time and appropriately making new amendments to Permit PA-03080 as he or she deems are necessary for the purposes of environmental protection
